There is a lot of confusion on this creamy layer income criteria..
As per my knowledge, and circular No. 36012/22/93, it is nowhere mentioned that salary will be excluded.
Also the Deputy secretary GOI, Mr KG Verma has written clarification notification (No. 36033/5/2004) to all Chief secretaries of all the states/UT, wherein it is clearly mentioned that, there are 3 type of income, salary, agriculture,other income.
Salary income and agriculture income should not be clubbed, which means just ignore agriculture income.
Suppose you have all these 3 types of income. Assume that A is agricultural income, S is salary and O is other income. So in total there could be 4 scenario.
1. S less than 8 lakh and O less than 8 lakh: You are in Non creamy layer.
2. S less than 8 lakh and O more than 8 lakh: You are in creamy layer.
3. S more than 8 lakh and O more than 8 lakh: You are in creamy layer.
4. S more than 8 lakh and O more than 8 lakh: You are in creamy layer.
